Legal [edit]

I just thought about the Legal documents after reading them again. Here are my thoughts:

Quote from the EULA:

"1. TERMS OF AGREEMENT

(a) Terms of Agreement. NC Interactive, Inc. and ArenaNet Inc. (collectively, "NC Interactive") offer to allow you to play its multi-player online computer games "Guild Wars," Guild Wars Factions, Guild Wars Nightfall, Guild Wars: Eye of the North, and/or Guild Wars Bonus Mission Pack as applicable (individually and collectively, the "Game(s)") conditioned on your agreement to all of the terms and conditions contained in this Agreement and your compliance with the posted Rules of Conduct.

Your use of the Game(s) constitutes your agreement to all such terms and conditions and your agreement to comply with the Rules of Conduct. To confirm your agreement, you must click on the "I Accept" button at the end of this Agreement. If you do not so agree, you must click on the "I Decline" button at the end of this Agreement, in which case you reject the offered terms of use and will not be permitted to play the Game(s).

If you have any questions regarding these terms and conditions or the Rules of Conduct, please contact NC Interactive customer service by visiting the support section of our web site, currently at the following link: http://support.guildwars.com.

(b) Amendments. NC Interactive may amend this Agreement or modify the Rules of Conduct at any time in its sole discretion on our web site via (a) the amended Agreement, currently at http://www.guildwars.com/support/legal/user-agreement.php or (b) the modified Rules of Conduct, currently at http://www.guildwars.com/support/legal/rulesofconduct.php. Amendments to the Agreement and/or modifications to the Rules of Conduct will be effective immediately upon posting. When logging onto the Service (as defined below) you will be asked to confirm your acceptance to any such revised terms and conditions. You agree to check this Agreement and the Rules of Conduct periodically so you will be familiar with their content as amended or modified from time to time. If you do not agree to the revised terms and conditions, you should contact NC Interactive immediately to discuss closure of your Account (also defined below)."

It says it has last been modified in March 2008, I can't remember starting up GW and it asking me to agree to the modified EULA, so I don't know if I actually did agree to them.

The Rules of Conduct have been modified on 8 October 2009, I also can't remember that I was asked to agree to the EULA once again when the Rules of Conduct were modified by starting up GW.

But I do check them from time to time, but everytime I read them on the official website I don't see the "I Accept" button at the end of the Agreement nor do I see the "I Decline" button at the end of the Agreement.

A part in the Rules of Conduct says:

  • (19) You will not exploit any bug in Guild Wars and you will not communicate the existence of any such exploitable bug (bugs that grant the user unnatural or unintended benefits) either directly or through public posting, to any other user of Guild Wars. Bugs should be promptly reported via "Ask a Question" at http://support.guildwars.com.


Thought it is funny because if i'm correct, reading or asking about a potentially exploitable bug is also against the EULA?


Another part in the Rules of Conduct says:

  • (20) You will not attempt to play Guild Wars on any server that is not controlled or authorized by NC Interactive or its designees.


Why did it make me laugh?

Well it's not like they would be able to ban you on that server. Also, when you play on a server not controlled or authorized by NC Interactive or its designees you did not agree to the EULA. They could ban your official account if you have one, but why play on a server not controlled or authorized by NC Interactive or its designees when you have an official account?

How to proof you are innocent if you got banned?[edit]

  • Would a dozen or more witnesses who have seen me playing the game suffice?
  • Record every minute you are playing?
    • Would this be enough to proof your innocence?
    • How would I do that?
      • Use screen capturing software?
      • Use a camcorder so you are able to also film your keyboard, mouse and hands?
      • Get two camcorders so you can point one to your keyboard and mouse and another to your screen?
        • How would I proof that I did not tamper with any of the recordings?
  • Search for software that is able to make a log of every move made on your PC?
    • Would this be enough to proof your innocence?
    • Would this be safe?
      • Can hackers use this information if they are able to obtain it?


How does Anet and/or NCSoft know you are using third-party programs?[edit]

  • Do they check manually?
  • Do they use something similar to Warden?
    • I have found the answer to this question.
  • Do they use something similar to VAC?
  • Do they use something similar to GameGuard?
  • Do they check their anti-cheat software if it gives any false positives?


The perfect bot?[edit]

Would a T-800 that is ordered to farm for you 24/7 be the perfect bot?

If I had the money I would build a simplified actual robot to sit behind my screen and bot, it's possible to already build something like that, it wouldn't look human and talk or do advanced things like the T-800, but it would still get the job done right?

What do you need to pull this off:

  • Brains.
  • Programming experience.
  • Money.
  • 2 computers, one to control the bot, one to run GW. Don't run both on the same PC, it would then be detectable.
  • A camera (to watch the screen and track movements and other in-game actions)
  • Robotic hands (to press keys on the keyboard and move the mouse).
  • Lots and lots of other materials.
  • A degree in advanced robotics would also help.

I am wondering tho, is this covered by the current GW EULA?

Quote from section 7. OFFICIAL SERVICE:

"You agree not to use any hardware or software, including but not limited to third party tools, or any other method of support which may in any way influence or advantage your use of the Service which is not authorized by NC Interactive, including but not limited to the use of 'bots' and/or any other method by which the Service may be played automatically without human input."

So this would count as a violation of the EULA. Alltho, if a human has built a machine like that, does that count as "human input"?


Life would be better without[edit]

  • Hate.
  • Misunderstandings.
  • Violence.
    • Violence is mostly dealt with even more violence, wich I dislike.
  • Jealousy.
  • Extremes.
