Shard's Opinion[edit]

I don't believe in any gods, so half of your analogies flew over my head. Yes, Anet's terrible lawyers have written documents that, if you take them literally, says they can stop service at any time. However, the EULA is not a law. Any judge with half a brain will throw the EULA out if you can convince him that Anet's sales strategy is to make people buy their product, then ban them all so their server maintenance cost is minimal. Also, if you want to take the EULA literally, Anet should ban every single player, since it states you're not allowed to use an operating system or a monitor or a mouse or a keyboard or an internet connection to play the game. The fact is that Anet discriminates. It's also a fact that they lie constantly. Support told Adrin they do not monitor whisper chat, even though he got banned for things he said in whisper chat. They've also said in the past that they do not ban people for things said in team or guild chat, when, again, both him and I have been banned for things in those channels. They also say they do not ban you in game for things you do on other websites, which is, again, false, since I got banned for a youtube video I posted.

In all honesty, Shard, I believe you. But my point is that in the realm of Guild Wars, Arena.Net reserves the right to refuse service to a person without any reason. In the realm of Guild Wars, Arena.Net reserves the right to lie. As such, by playing the game you are implicitly agreeing to these terms, and that will not change, matter how much you want it to change. Acting without due cause may make Arena.Net a terrible company, but as long as you keep your head down, you will be able to play their game without any major clashes. I would love a front row seat at a hearing. Shard vs ArenaNet. General ANet contridictions, countered by did you say these things "why yes". Followed up with the Wasabi situations (and the loads of evidence there), countered again by did you say this on the wiki. Followed by the Gaile vendetta (maybe with the witnesses oohh!), countered by umm did you say this and we are trying to run a business. Closing statements, ANet's hypocrisy and Shard has under 10 marks but our EULA says we can do anything. Judge rips EULA in half criticizes the fail and says business is not > morals. Shard I only listed this as opinion since all arguments within this thread are based on assumptions and not solid proof. This is not a request for proof, as I really do not care. OMG it's just a game. Play nice, or don't play at all. The first line of the user agreement says enough, in that ANET allows you to play their game provided you follow their rules. Like it or not, it's their ball, and they can take it away and send you home if they want to. Clearly you know what actions are necessary to get banned, so avoid doing them. Simple logic.

Ashes' Opinion[edit]

You make a decent point, but you need to remember that we are in fact customers of Arenanet. They are not legally bound (through the EULA or otherwise) to provide us with this service, but there is an implicit agreement between Arenanet and us customers that they will provide this service if they want us to continue to purchase their products, whether it be bonus content packs, pet unlock packs, more storage slots, or Guild Wars 2. If they fail to live up to their side of this implicit deal - that is, provide some kind of regular updates, continue to provide server space, and not completely screw up the game. With the exception of a few cases (Shard, I'm sorry, but you are just a very vocal minority), Arenanet has held up their side of the deal. While we can reasonably expect some improvements from Arenanet, we cannot expect them to fix every single problem we find.
